1. TERMS AND CONDITIONS
Please review the following basic terms that govern your use of, and purchase of, products from SCHOLARSAYZE.COM. Please note that your use of SCHOLAR&SAYZE.COM constitutes your agreement to follow and be bound by those terms.
SCHOLAR & SAYZE Limited (hereafter “SCHOLAR & SAYZE” or “WE”), provides the website www.scholarsayze.com for the sole purpose of selling garment products online. These Terms & Conditions shall apply in the latest version to all orders and contracts made between SCHOLAR & SAYZE and the consumer who is a private person making a purchase through our website (hereafter “consumer” or “customer”). No subsequent agreement in any way altering these Terms & Conditions shall be binding on SCHOLAR & SAYZE unless made in writing and signed by an authorised officer of SCHOLAR & SAYZE ™.
2. IMPORTANT ADVICE
2.1. The website www.scholarsayze.com is our official store and no other website or other platform is considered as part of our business and therefore, should be classed as unofficial or deemed as “counterfeit”.
2.2. Any goods on our website www.scholarsayze.com are presented in a true-to-life manner as best we can. Due to different settings or performances of screens or printers, illustrations can differ from the real appearance. The consistency cannot be guaranteed by SCHOLAR & SAYZE.
2.3. The products as presented on the website can be out of stock or unavailable for other reasons or vary in price in individual cases. The presentation of goods on the website is no binding offer. Unless specified otherwise, all mentioned prices are displayed in POUNDS (£).
2.4. Please note that order(s) shipped outside of the United Kingdom (UK) may be subject to import taxes, customs duties, and fees levied by the destination country. The customer or recipient of an order may be subject to import taxes, customs duties, and fees, which are levied once a shipment reaches the recipient’s country. Additional charges for customs clearance must be borne by the customer or recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country.
2.5. All products are delivered within sealed packaging. The obligation for return and refund does not apply when the packaging has been broken or damaged.
3. CONTRACT
3.1. All contracts between the customer and SCHOLAR & SAYZE are effective by transferring any chosen items into the shopping cart on the website and upon completion of the order form and its dispatch by clicking the button “Pay x” (where ‘x’ is the total payable) or pressing “Return” or “Enter” on the keyboard (binding order of the customer), and finally upon receipt of the order confirmation of SCHOLAR & SAYZE sent to the e-mail account of the customer as stated in the order form or alternatively upon shipping of the goods at the latest. The order confirmation email is set up as an automated third-party process and is deemed as received by the customer soon after it is sent and we are not responsible for system errors that may interrupt this process. The customer accepts these Terms & Conditions by clicking the “Pay x” (where ‘x’ is the total payable) button on the order form. Any mistakes in the order form can be corrected by contacting SCHOLAR & SAYZE immediately at sales@scholarsayze.com before dispatch. The prices valid at the date and time of the order apply.
3.2. We do not store the contract text as a file, and it cannot be downloaded again after your order has been completed. You can print out the order data immediately after the purchase process.
3.3. Our goods are dispatched and delivered via a third-party carrier either Royal Mail, DPD, or UK Mail/DHL. In the unfortunate event that our supplier does not deliver the goods as ordered by us according to the distribution agreement between the supplier and us, we are entitled to terminate the contract, when the supplier breaches its duties contrary to the distribution agreement. In this case, we will give a brief notice, that the ordered product is not available and eventual payments will be fully refunded in this case.
4. PRODUCT AVAILABILITY
Although availability may be indicated on SCHOLARSAYZE.COM, we cannot guarantee product availability and products, subsequently, may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order.
5. PRODUCT PURCHASE FOR PERSONAL USE ONLY
You may purchase products only for personal use and not for resale. By placing your order, you certify that you are purchasing products for personal use only and not for resale. We reserve the right to refuse orders for any reason without explanation.
6. COLOURS
We have made every effort to display as accurately as possible the colours of our products that appear at the SCHOLARSAYZE.COM. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be calibrated in comparison to ours.
7. SIZING
Size charts are available on each product page. Size charts are a general guide to compare various size scales. As each product cut may vary in size – please contact help@scholarsayze.com with specific sizing questions.
8. DELIVERY AND SHIPPING
Most inland orders are shipped within 1-2 business days of the order, however in some rare cases (such as sales) please allow 5-7 business days. Delivery time is based on the shipping method.
Please Note* Standard Delivery (First Class Mail) delivery is not guaranteed and is at the risk of the buyer. Unfortunately, SCHOLAR & SAYZE LTD. will not be responsible for replacing lost, delayed, damaged or stolen packages shipped via First Class Mail.
8.1. The shipping will be carried out to the “shipping” address given by the customer. Periods of delivery are non-binding unless otherwise expressed.
8.2. We are unable to deliver to a military base or diplomatic location APO/FPO/DPO addresses, as well as P.O. Boxes. PLEASE NOTE: Some countries may have restrictions on the receipt of specific items.
8.3. We handle and dispatch orders on a daily basis (working days only). We do not offer Saturday/Sunday delivery. Please note that we aim to dispatch all orders within 1-2 business days of the order (Monday – Friday except on Bank or Public Holidays), on receipt of payments in full. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. SCHOLAR & SAYZE is not responsible for any delays caused by destination customs clearance processes and/or due to Force majeure.
8.4. Depending on the selected shipping method, our carrier will deliver your parcel according to their services and terms and conditions. We are not liable or responsible for any of these terms and conditions. For Standard Shipments the usual delivery time (after dispatch) is between 3 to 5 days, depending on your location it might take longer. For Express Shipments the usual delivery time (after dispatch) is 1 to 3 days depending on your location it might also take longer. PLEASE NOTE: Some countries may have restrictions on the receipt of specific items. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. SCHOLAR & SAYZE is not responsible for any delays caused by destination customs clearance processes.
8.5. Your order may be subject to import duties and taxes. You will be responsible for paying additional charges for customs clearance; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; please contact your local customs office for further information. Additionally, when ordering from www.scholarsayze.com, you are the importer and must comply with all laws and regulations of the destination country. You authorise us to designate a carrier to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise and advance (on your behalf) any duties and taxes owed by you. If in doubt, please contact your local customs office for current charges before you place your order.
8.6. If the customer has special requests concerning the type of shipment, e.g. express shipment, the additional costs shall be charged and accepted by the customer. The risk shall be transferred to the customer when the goods are transferred to a forwarder or carrier, in any case when they leave the warehouse of SCHOLAR & SAYZE.
8.7. All our goods are dispatched in prime retail standard condition and therefore, we cannot be responsible if goods arrive in a damaged state. Any queries or concerns must be raised with the carrier.
8.8. Our goods are dispatched and delivered via a third-party carrier either Royal Mail, DPD, FedEx or UK Mail/DHL. The terms and conditions of the carrier will apply additionally and can be called from their specific website.
8.9. For package tracking services, we will provide you with the tracking number details when available at the time of dispatch so you can track your delivery accordingly via the carrier’s website tracking facility.
9. PAYMENT
Payments including shipping fees are accepted via credit card or PayPal. If ordered goods are not available at present, any amounts credited in advance will be fully refunded immediately.
9.1. PayPal
By choosing the PayPal payment option, the customer agrees to pay immediately after the purchase order. Affirmation of the contract and delivery will be effected upon receipt of payment. SCHOLAR & SAYZE is entitled to cancel an order if the payment is not made within five (5) working days within the order.
9.2. Credit Card
All credit card information (numbers, expiry dates, etc) will be automatically handled with an encrypted protocol to ensure that neither SCHOLAR & SAYZÉ ™ nor the third party has access to this information. This credit card information will only be used again after purchase transaction in the case of eventual refunds. Please note that this is a direct withdrawal.
9.3. Security
SCHOLAR & SAYZE enables the security software SSL (Secure Socket Layer), which is based on asymmetrical encryption to prevent malpractice or deception or copying of credit card information during the purchase process. This is visible at the checkout by the “green padlock” mark located in the URL for your peace of mind. We also have security in place and a security Certification Trustmark with ‘McAfee SECURE’ as a ‘Trusted Site’. Rest assure your bank details are kept safe and secure at all times.
9.4. Retention of Title
All goods will remain in our property until payment is received in full. In the case of a delay of payment over a period of more than five (5) working days, SCHOLAR & SAYZE is entitled to terminate the contract and claim back the goods.
10. WARRANTY + LIABILITY
10.1. Condition of the Goods
All descriptions, designs, illustrations, technical data, weight, measurement, and specifications, which are contained in product folders, catalogs, circulars, announcements, or price lists, have a purely informative character. We do not guarantee the correctness of these data.
10.2. Liability
If you believe a product has a material or manufacturing defect, please stop using the product and contact us at info@scholarsayze.com with photo(s), production tracking number, invoice, and a description of the defect. We will contact you in order to confirm how to proceed. Please note that if we find the product has been damaged intentionally or through misuse, you will not be entitled to a claim. Compensation for consequential damage caused by defects in delivered goods shall be excluded subject to our approval.
The following restrictions shall apply:
SCHOLAR & SAYZE shall not be liable for other than by injury of lives, bodies, and health developing damages unless caused by SCHOLAR & SAYZE or its employees, representatives or supporters with gross negligence or intent or based on the culpable injury of a primary contractual obligation by SCHOLAR & SAYZE or its employees, representatives or supporters. Any further liability shall be ruled out. Data communication over the internet cannot be ensured error-free and/or at any time available after the present state of the art. Therefore, we are not liable for the constant and continuous availability of our website. We are not responsible or liable for the availability and the content of a third party’s websites reachable over hyperlinks from our website. The content of the third party’s websites will not be appropriated by SCHOLAR & SAYZE in any case.

11. SALES & RETURNS
11.1 Conditions
We want you to be happy with our products. Should you for any reason be unhappy with our delivered goods, you have the right to return the unused product within 14 days after the arrival of the goods. Returns are not accepted for any product after 14 days. You must return the goods together with your original receipt and the original packaging including the affixed tags. Subsequently, we will inspect the returned goods and arrange a refund (excluding the shipping fee) to your original method of payment or for an online store credit. The term begins with the receipt of the goods. Please contact us at returns@scholarsayze.com and we will provide you with the returns process requirements. We do not cover the shipping costs of returning your goods, neither cover the shipping costs of replacing a new piece. Please note that you are liable for the shipments of the items. Returns do not apply to products sold during a sample sale, see section 11.4 Sample Sales.
If an item is returned that received free shipping, then the shipping fee will be deducted from the refund amounts. If an item is returned that makes the value of the remaining order less than the amount to qualify for free shipping, then the shipping fee will be deducted from the refund amounts.
11.2. Consequences of Refund
In the case of an effective revocation, both parties are entitled to demand the refund of achievements mutually. In the event of deterioration of the goods, SCHOLAR & SAYZE is entitled to claim a refund as compensation; this shall not apply when the deterioration is only based on try-out of the goods – comparable with the situation in a shop. Further, you can avoid the claim for refund as compensation by trying the goods carefully within the term. In the event that the returned goods have been used, worn, washed, altered, the packing materials, and/or the hang tag has been removed, no refund will be issued. SCHOLAR & SAYZE reserves the right to change the terms & conditions of the refund policy without prior notice to the customers. Shipping costs of the delivery are not refunded by SCHOLAR & SAYZE. Refunds will be carried out within seven (7) business days upon receipt of the returned and checked item.
11.3. Carrier for Returns
You can select the carrier for return using any method of your choice, at your expense. We recommend using a trackable and insured service. Make sure to include the returns form included in your package. We kindly ask you to send us the tracking number and pre-alert of your return. You are responsible for the carrying cost of your returns. We cannot be held responsible for goods that you return and we do not receive, subsequent to you not using a trackable returns service.
11.4. Sample Sales
We may run samples sales throughout the year to sell sample designs, near-perfect products, to clear excess stock or to introduce new products to market at a much lower price point. Please note that sample designs are near-perfect products that may come with minor production faults such as print errors, a change in design or without brand lables, but our standardised product quality is still crafted into the core product. All sales are final and no refunds are provided thereafter.
12. EXCHANGE POLICY
If you ordered a product from SCHOLAR & SAYZE and want to exchange it for another colour, size, or a different product in our product range, we offer an Exchange service for the unused product within 14 days (with your receipt and the original packaging including attached hangtag) after the arrival of the goods. Exchanges are not available for any product after 14 days. If you would like to exchange an item, we suggest that you place a new order for the new item you require before returning your original purchase to ensure desired that your exchange item is in stock. Please contact us on returns@scholarsayze.com and we will provide you with the exchange process requirements.
In any case, we kindly ask you to send us the tracking number and pre-alert of your return for exchange, including the replacement product of your choice. We will ship this replacement product depending on availability and if the new shipping costs for another shipment are balanced out. Should your previous purchased product exceed the amount of replacement product plus new shipping costs, we will make a refund of the difference or can create a store credit for your next purchase. If the amount of your previously purchased product is less than the new replacement product plus new shipping costs, you must pay the difference up front before your replacement product is dispatched. All copyright trademarks, and other intellectual property rights in all text, images, and other materials on this website and/or application are the property of SCHOLAR & SAYZE or are included with the permission of the relevant owner. All such rights are reserved by SCHOLAR & SAYZE and its licensors.

The trademarks, logos, and service marks (“Marks”) displayed on this website are the property of SCHOLAR & SAYZE and or other third parties involved. You are not permitted to use these Marks or any marks which are colourably similar without the prior written permission of SCHOLAR & SAYZE.
13.2. Copyright
Without obtaining the prior written consent of the copyright owner, you are not permitted to publish, modify, distribute, or reproduce in any format, any of the content which appears on this website or on any of our artwork designs nor may you use any such content in connection with any business or commercial enterprise.
14. GOVERNING LAW & GENERAL TERMS
14.1. The law of the United Kingdom (UK) shall apply.
14.2. The Terms & Conditions of SCHOLAR & SAYZE will supersede any other general terms and conditions binding upon the customer.
14.3. Eventual ineffectiveness of single provisions does not touch the effectiveness of the remaining provisions.
15. INACCURACY DISCLAIMER
From time to time there may be information on SCHOLAR & SAYZE that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted your order). We apologise for any inconvenience this may cause you.
16. DISCLAIMER
SCHOLAR & SAYZE and all contents of the site are provided on an “as is” basis without warranties of any kind, either express or implied, including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge, by your use of the site, that your use of the site is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of our site, and that SCHOLAR & SAYZE shall not be liable for any damages of any kind related to your use of this site.
